NY Enacts Bills to Curb Robocalls and Call Spoofing
On November 8th, 2021 New York Governor Kathy Hochul signed into law two bills aimed at curbing robocalls and illegally spoofed calls:
- S.6267a/A.268a: Voice service providers must block robocalls from certain categories of phone numbers, including invalid numbers, numbers set up to receive inbound traffic only, and valid numbers that are not currently assigned to any subscribers.
- S.4281a/A.585a: Voice service providers must implement STIR/SHAKEN caller ID authentication framework. Willful or negligent noncompliance could result in civil penalties of between $10,000 to $100,000.
Although these new laws will likely have little impact on the day-to-day operations of legitimate callers, they could be part of a trend towards states enacting their own calling rules.
In September, the National Association of Attorneys General held their inaugural “RoboCall Summit”. Attorneys General offices from across the US continue to receive complaints about illegal and unwanted calls. As a result, several Attorneys General offices mentioned advocating for new legislative agendas to stem the flood. Both Florida and New York updated calling rules this year, and more updates could come in 2022 and beyond.
Callers should make sure to stay on top of new laws that may impact their calling activities and update policies, procedures, and training to maintain compliance with new rules.
